Criminal Liability for Deepfake Crimes: Legal Classification Challenges in UAE Legislation Compared to French Law
Abstract: This study examines criminal liability for deepfake-related conduct and the challenges associated with its legal classification under UAE and French law. It evaluates the adequacy of relevant UAE criminal and cybercrime provisions and compares them with the French legal approach to manipulated digital content, privacy, identity, and image protection. Using descriptive-analytical and comparative legal methods, the study examines relevant legislation together with selected doctrinal and judicial approaches. The analysis indicates that UAE law primarily addresses deepfake-related conduct through general provisions concerning cybercrime, privacy, and forgery, which may create uncertainty in legal classification. French law provides comparatively more specific mechanisms for addressing certain forms of manipulated digital content. The study therefore recommends clearer UAE legislative provisions defining deepfake-related conduct and the applicable elements of criminal liability while maintaining appropriate protection for individual rights and freedoms.
